Me Media Kids's Terms of Service
Me Media Kids ("Me Media Kids", "we", "us", or "our") provides Services that allow you to use your own digital pictures, along with names and physical descriptions, to customize and purchase books and other products.
This Terms of Use Agreement ("Agreement") sets forth the legally binding terms for your use of Me Media Kids services. Before beginning a custom project, and/or before setting up your Me Media Kids account, please read the following Terms of Service ("Terms") carefully. If you agree to these Terms and desire to use the Me Media Kids service ("Service"), please check the "I Have Read And Agree With The Terms of Service" box and click the Continue button. By following this process, you agree to be bound by the Terms of this agreement. To decline acceptance, simply leave the site. By accepting the Terms, you understand that any breach of these Terms may result in your termination of Service. If you wish to use Me Media Kids services you must read this Agreement and indicate your acceptance during the Registration Process.
BY USING THE SERVICES OFFERED ON THE ME MEDIA KIDS WEB SITE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND BY ME MEDIA KIDS' PRIVACY POLICY INCORPORATED BY THIS REFERENCE. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS, YOU ARE NOT PERMITTED TO USE THE SERVICES OF OUR SITE.
From time to time, Me Media Kids may change these Terms and such changes shall be effective upon posting by Me Media Kids. For updated Terms, please refer to this site occasionally for any changes. You agree to be bound by any changes to this Agreement when you use Me Media Kids services after any such modification is posted. Additionally, you will be required to read and accept these Terms, in their most current form, each time you create a new project on the Me Media Kids website.
Eligibility
As a user of the Me Media Kids site and its Services, you represent and warrant that the information you provide during account creation, account management, and project creation is truthful and accurate. You acknowledge that you are thirteen (13) years or older. You must refrain from using this site and its Services if such use violates any applicable law or regulation. Your account may be terminated, without warning, if we believe that you are under 13 years of age.
Term
This Agreement shall remain in full force and effect while you use the Me Media Kids Services or are an account holder. You may terminate your account at any time, for any reason, by following the instructions on your Account page. We may terminate your account at any time, without warning.
Your Submissions
Me Media Kids does not and cannot review all submissions. Me Media Kids is not responsible for submitted material and reserves the right to remove or delete submissions that we, in our sole discretion, deem obscene, offensive, defamatory, libelous or in violation of trademark or copyright laws, or otherwise unacceptable.
You agree to NOT submit any material that may give rise to a possible civil or criminal liability under applicable law, including any material that is racist, threatening, obscene, profane, pornographic or furthering of illegal activities. You agree to NOT submit any material that could infringe on the rights of privacy, publicity or copyrights without the consent of the owner of these rights and the persons (or, where applicable, their parents or legal guardians) who are shown in the material.
You agree to NOT submit any material that exploits any person under the age of thirteen (13) in a violent or sexual manner.
You acknowledge and agree that any submission made by you may be published, copied, customized, removed, transmitted and shown by Me Media Kids for the purposes of delivering the Services. You warrant that all moral rights in any uploaded images and materials have been waived.
Me Media Kids will not be liable or legally responsible for the content of any submission.
Your Me Media Kids Account
To save projects and to purchase products from Me Media Kids, you are required to create a password protected account. You are responsible for choosing your password and maintaining its confidentiality to protect your information and your content with Me Media Kids. You agree to notify Me Media Kids immediately if you suspect any unauthorized use of your account and are solely responsible for the use of your account.
Me Media Kids reserves the right to access your account as necessary to maintain our Service to you and/or to follow a court order, complaint, subpoena or a legal request or inquiry from a governmental authority.
There is no charge to create an account with Me Media Kids.
Me Media Kids reserves the right, at its sole discretion, to cancel some or all Services, to remove some or all images in your account or to discontinue your account if it has been idle for more than one year.
Purchase Rules
To purchase products from Me Media Kids you must be at least eighteen (18) years of age with either of the following: (1) a valid credit card number (VISA, MasterCard, American Express) issued in your name with correct and current billing information; (2) a valid PayPal account.
By providing your credit card and/or PayPal information, you agree that Me Media Kids is authorized to immediately invoice your selected account for all fees and charges payable as a result of your purchase, including any required taxes or duties.
Me Media Kids reserves the right to accept or decline your purchase for any reason.
Satisfaction Guarantee
Quality of Manufacture and Fulfillment
Me Media Kids takes full responsibility for the manufacturing quality of your products. If you are not fully satisfied with the quality of the manufacture of your product, Me Media Kids will remake your product and ship it to you at no additional cost.
If your products are not fulfilled properly (wrong customized product sent to you), Me Media Kids will work diligently to rectify the issue.
For any and all issues with quality of manufacture or fulfillment, please contact support@memediakids.com and we will make it right.
We may ask you to return unsatisfactory product to Me Media Kids for review.
Customer Mistakes
Me Media Kids works very hard to help you create beautiful products, with helpful suggestions and tips throughout our site. However, we cannot ensure that work completed by you is up to your satisfaction. You hereby acknowledge responsibility for your misspellings, image placement, image quality (including low resolution images that may appear blurry when printed), selected characteristics (including but not limited to gender, skin color, hair color or other global selections) or other errors, as well as any omissions in any project that you submit for purchase. If there is something more that we can be doing to create an easier environment in which to create products, please contact us at feedback@memediakids.com.

Me Media Kids may from time to time provide links to third-party sites that might be of interest to you. We cannot control the availability or content of these sites. You agree to indemnify, defend and hold harmless Me Media Kids, our subsidiaries, affiliates, officers, directors, employees, agents, licensors, suppliers and any third-party providers to the Service from any loss, damages, liability and expenses, including reasonable attorneys' fees, that result from any violation of these Terms, any breach of any provision of these Terms, and/or any activity related to your account (including wrongful conduct) by you or any person accessing the Service through your account.
Claims
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon. Any and all claims against Me Media Kids must be brought, if at all, within one (1) year from the accrual of the cause of action.
Disputes
If there is any dispute about or involving Me Media Kids, you agree that the dispute shall be governed by the laws of the State of Oregon, without regard to conflict of law provisions, and you agree to exclusive personal jurisdiction and venue in the state and federal courts of the United States located in the State of Oregon, City of Portland.

TO THE EXTENT LEGALLY PERMITTED UNDER APPLICABLE LAW: THE SERVICES AND/OR MATERIALS AVAILABLE THROUGH ME MEDIA KIDS' WEBSITE ARE PROVIDED ON AN "AS IS" BASIS AND "AS AVAILABLE" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED; ME MEDIA KIDS EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Limitation of Liability
TO THE EXTENT LEGALLY PERMITTED UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL ME MEDIA KIDS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS FROM YOUR USE OF THE SERVICES, EVEN IF ME MEDIA KIDS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE USE OR THE INABILITY TO USE ME MEDIA KIDS' SITE, MATERIAL, IMAGES, CONTENT OR SERVICES, FROM ANY CHANGES TO OUR SITE OR OUR SERVICES, OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSIMISSIONS OF DATA. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, ME MEDIA KIDS LIABILITY TO YOU FOR ANY CAUSE OF ACTION WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID FOR THE MY MEDIA KIDS SERVICES PAID FOR DURING THE TERM OF THIS AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY: THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Miscellaneous
These Terms constitute the entire agreement between you and Me Media Kids regarding the Services and supersede all other communications, written or oral, with regard to the Services.
Should any provision of this Agreement be held to be void, invalid, unenforceable or illegal by a court of law, the remaining provisions will remain valid and enforceable. Any failure to enforce any provision of this Agreement will not constitute a waiver of such a provision or of the right to enforce such provision.
Me Media Kids reserves the right to ship and deliver partial orders at no additional cost to you.
The risk of loss for each product shipped to you passes from Me Media Kids to you at the time of shipment from Me Media Kids' designated point of shipment. Under no circumstances shall Me Media Kids be responsible for any loss or damage, including personal injury or death, resulting from the use of the Services.
Without notice, Me Media Kids may at any time assign our responsibilities and rights hereunder.
